Terms & Conditions

Welcome to NovikHealthFit. By purchasing personal training services, online coaching, memberships, or any other services provided by NovikHealthFit, you agree to be bound by the following Terms & Conditions.

1. Eligibility

Clients must be at least 18 years of age or have the consent of a parent or legal guardian before participating in any training program.

2. Health & Medical Clearance

The client confirms that they are physically able to participate in exercise and personal training.

 

The client agrees to:

 

  • Disclose any existing medical conditions, injuries, medications, or physical limitations before beginning training.

  • Inform their trainer of any changes to their health throughout the duration of training.

  • Obtain medical clearance from a licensed healthcare provider if advised or if they have any condition that could affect their ability to exercise safely.

3. Assumption of Risk

The client understands that participation in physical exercise carries inherent risks, including but not limited to muscle soreness, strains, sprains, falls, cardiovascular events, and other injuries.

 

The client voluntarily assumes all risks associated with participating in training sessions.

4. Release of Liability

To the fullest extent permitted by law, NovikHealthFit, its owners, employees, contractors, and trainers shall not be liable for any injury, illness, loss, damage, or expense arising from participation in training services, except where caused by gross negligence or willful misconduct.

5. Payment

  • Payment is due before services are provided unless otherwise agreed in writing.

  • Prices are subject to change without notice.

  • Outstanding balances may result in suspension of services until payment is received.

6. Cancellations & Missed Appointments

Clients must provide at least 24 hours' notice to cancel or reschedule a session.

 

Appointments cancelled with less than 24 hours' notice or missed without notice will be charged in full.

 

Repeated late cancellations or no-shows may result in termination of services.

7. Refunds

Refunds are governed by the Refund & Cancellation Policy, which forms part of these Terms & Conditions.

8. Session Expiry

Unless otherwise stated in writing:

 

  • Individual sessions expire 12 months from the date of purchase.

  • Training packages expire according to the package purchased.

  • Expired sessions cannot be redeemed or refunded.

9. Trainer Substitution

If necessary, NovikHealthFit reserves the right to assign another qualified trainer to provide services.

10. Online Coaching

Clients participating in online coaching understand that:

 

  • Results depend on consistent participation and adherence to the program.

  • Internet connectivity and compatible devices are the client's responsibility.

  • Workout plans and educational materials are intended solely for the purchasing client.

11. Client Responsibilities

Clients agree to:

 

  • Arrive on time for scheduled sessions.

  • Wear appropriate exercise clothing and footwear.

  • Follow trainer instructions to the best of their ability.

  • Notify the trainer immediately if they experience pain, dizziness, or discomfort.

12. Results Disclaimer

While every effort is made to help clients achieve their goals, NovikHealthFit does not guarantee specific fitness, weight loss, strength, or health results. Individual outcomes vary based on numerous factors including consistency, nutrition, lifestyle, and individual physiology.

13. Intellectual Property

All workout programs, nutrition guidance, educational materials, videos, documents, and other content provided by NovikHealthFit remain the intellectual property of the company.

 

These materials may not be copied, shared, reproduced, sold, or distributed without prior written permission.

14. Privacy

Personal information collected by NovikHealthFit will be handled in accordance with applicable privacy laws and used only for providing services, communicating with clients, processing payments, and maintaining business records.

15. Termination

NovikHealthFit reserves the right to terminate services without refund if a client:

 

  • Behaves abusively or disrespectfully.

  • Harasses staff or other clients.

  • Engages in unsafe conduct.

  • Violates these Terms & Conditions.

16. Force Majeure

NovikHealthFit shall not be responsible for delays or failure to perform services due to circumstances beyond its reasonable control, including but not limited to severe weather, natural disasters, government restrictions, power outages, illness, or other unforeseen events.

17. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the province or state in which NovikHealthFit operates and the applicable federal laws.

18. Changes to These Terms

NovikHealthFit reserves the right to update or modify these Terms & Conditions at any time. Updated versions become effective upon publication and apply to future services.
